Community Center Insurance Notice

At the Spring Members Meeting,
held at the CHPOA Clubhouse on Saturday, April
12, 2008, pursuant to notice, the Board
recommended that due to excessive premiums on
wind insurance that CHPOA not purchase wind
insurance for the upcoming insurance year, and
that instead, the Board investigate alternatives
to wind insurance (such as high impact windows,
improved roof fastening, favorable shift in
insurance rates, etc.). The membership
agreed, and resolved that the Board not purchase
wind insurance, monitor wind insurance rates,
and investigate alternate methods of wind
protection, and report its findings to the
members.
Letter to the Florida Department of
Community Affairs

The Board of Directors has
been very active in working with county
officials to ensure that development in our area
is carried out in full compliance with all
applicable laws, land use plans, and with
provision for adequate infrastructure. As the
latest event in this ongoing effort, President
Marvin Medintz in January sent a letter to the
Florida Department of Community Affairs on
behalf of Cape Haze residents. This letter
details our concerns with recent county
decisions impacting development within the Cape
Haze peninsula. To view this

Our greatest chance
for an impact on the development of the Cape
Haze peninsula comes when we all participate.

Letter from the President

I’m going to update you on a
number of issues in this letter.
Our Clubhouse/Community Center
With the value of the average
home here in Cape Haze approaching seven figures
many wonder why we don’t have the amenities
commensurate with a community with that level of
value? One of the key deficiencies has been our
aging and ailing Clubhouse. Eva Furner and Pam
Neer have been working diligently on a plan to
economically rebuild and significantly enhance
this center piece of our community. The CHPOA
Board of Directors and a preponderant majority of
the members, present at the April 15 meeting,
voted to carry the renovation proposal forward to
the next step and present it for overall CHPOA
member approval at a special meeting to be held on
May 20.
We need an overwhelming
majority of our community behind it, not just in
talk but in monetary terms as well. Thus, for the
project to go ahead we need at least 90 member
units to support it and show that support with a
"Go" vote and a $500 check, as well as a
commitment for another $500. While we expect
higher dues in the future as we go ahead with this
(in order to pay the resulting debt we will incur)
the value receive will be commensurate with the
added costs. Despite these costs, we support this
project because it’s the right thing for Cape
Haze. I hope that you will too.

Development
The character of Cape Haze will
change as property owners in the area agree to
sell to developers who are taking advantage of
zoning to build multi-family, multi- story condos.
A proposed development, "Aquia
at Cape Haze", is being targeted for the area just
North of Cape Haze on the eleven acre parcel often
referred to as "the boat ramp property". Stock
Development of Naples has unveiled plans to build
108 condo units, some of which will be five
stories, and 82 feet high. We believe that
this property, the majority of which is within
1200 feet of the waters of Lemon Bay, should not
be permitted to have buildings of this height
since the county code in respect of this prohibits
buildings above three stories within 1200 feet of
Lemon Bay. Accordingly we have made our views
known to the County Commissioners and will fight,
on your behalf, any attempt to build anything
above three stories. A meeting of the county
Development Review Committee is scheduled for 1 PM
on Thursday May 11th at the Murdock
complex. Come to the meeting, if you can, and
speak up.
If you can’t come, please take
the time to write to your County Commissioner Tom
Moore and make him aware of your concern and
opposition to the granting of any height
variances. Keep in mind that elected officials
respond to numbers. One letter each from 200
people is far more powerful than 200 letters from
one person.
Remember the community you save
may be your own!
In other development matters, a
plan was put forth to convert Wildflower Golf
Course into condos, stores etc. It was at variance
with a number of state and county codes and
statures. Percy Angelo Medintz and Marvin Medintz
did the necessary research and found that the
county was willing to approve this development
without due regard for these statutes. They
forcefully brought this matter to the attention of
the Board of Charlotte County Commissioners who
then voted to table the plan. Thanks and great job
Percy and Marv!
Roads, Sewers and Traffic
Signal
We expect that the long awaited
paving of Cape Haze roads will occur in the
May-August time frame once the contractor finishes
in South Gulf Cove. We have also looked into the
issue of sanitary sewers for our community and the
thinking at this time is to not to petition the
county for them since the need is small and the
costs are high.
We do, however, see a strong
need for a traffic signal at the corner of Cape
Haze Drive and Placida Road. When all of the
proposed condo complexes come on stream the
traffic volume will be significant enough to raise
the risk level to an unacceptable status. We are
working with the county personnel to get one
installed before we have a fatality. So, I also
ask you all to write to Commissioner Moore and
strongly request that we get one here before any
one of us become that first casualty.

Letter from the President

Since our January meeting was
subject to some disruption, I am using this
opportunity to update everyone on the key issues
that face our community since they did not all
receive full coverage at the meeting. I also want
to use this forum to update all our residents on
the status of roads and sewers as well as to call
your attention to the risks posed by the
development in our area and avail all of you a
vehicle for communicating with our elected
representatives.
Your Board and I will continue
to move forward executing our plan to maintain and
improve the overall quality of life here in Cape
Haze.
SEWERS: At the January meeting
there was a discussion about whether or not we
want to install sewers in Cape Haze. It makes
sense to install sewers if there is an
environmental issue. Charlotte County Utilities
(CCU) is unaware of any health issue and
consequently we are not on their radar scope for
sewer installation. Further, the nature of our
community - sandy soil, large lots and absence of
full development - suggests that the need is not
great. These facts plus the extremely limited
capacity at CCU indicate that we will not be
dealing with this issue for years to come.
REPAVING: The long awaited
repaving of our streets is expected to be
completed sometime during the second and third
quarters of this year. The contract signed by the
county road department gives the contractor
flexibility in the timing of the job, hence the
variability of the schedule. Related to this, I
have also requested that the county road
department do a comprehensive study with respect
to a traffic signal at the intersection of Placida
Road and Cape Haze Drive.
BYLAWS: Two members of the
Board and a former President (Gil Bricault, Marv
Medintz and Homer Hoe) have taken a look at the
bylaws which govern our association. They have
made recommendations to the Board for updating and
rationalizing our bylaws which were approved at
our February board meeting. These changes are
designed to allow CHPOA to function more
effectively. The new bylaws have been sent to all
members of CHPOA for review and ultimate approval.
We have made the approval process as clear and as
easy as possible for you by including a proxy
form, an explanation of the changes and a return
envelope. Our goal is to have them finally
approved at our special membership meeting on
April 15. Even if you plan to be at the April 15
meeting please send in your proxy. We also plan to
post our bylaws on this web site. YOUR BOARD
RECOMMENDS AND URGES YOUR APPROVAL OF THE CHANGES.
DEVELOPMENT: One of the major
threats to our quality of life in Cape Haze is the
development currently occurring and planned in the
Placida Road (CR-775) corridor. While your
association and others will express our views on
this development, the county leaders respond best
to numbers. By this, I mean numbers of voters and
residents who strongly express their views on this
matter to the County’s Development Review
Committee and to the County Commissioners
themselves.
Charlotte County is required by
both state and federal mandates to have its own
Comprehensive Plan for Development. Such a plan
does exist; however, many of the proposed
developments in our area fail to comply with the
plan. It also seems that county officials do not
feel constrained by their own plan.
Therefore, unless we all speak
up now, what we will likely see in the near future
will be higher density multi-story buildings
surrounding Cape Haze.
So please write, call, e-mail
or even visit your county leaders and tell them
that you are opposed to the granting of variances
to height and density for the developments planned
for our area. Tell them, further, that you expect
them to adhere to their own comprehensive plan as
well as assuring adequate infrastructure in our

Letter from the President (Posted 11/13/05)
Hilary and I are delighted to be back in Cape Haze
after a fairly active summer at the New Jersey Shore, with some side
trips to, among other places, the Mississippi coast. In addition we
got to host some refugees from Katrina: our son, daughter-in-law and
their two children. Happily all are safe and have returned to
Gulfport. After seeing our son’s pictures of the devastation wrought
by the hurricane, it clearly emphasizes the fact that when the order
to evacuate comes, it’s very wise to heed it.
Your board of directors is continuing the
direction we outlined to you at our last meeting.
You will note that we now have a new fountain at
the entrance to Cape Haze. On behalf of all of us I thank Gil
Bricault and his committee for the great job they did on this. In
addition to Gil the committee consisted of Paul Wunsch, Cindy
Creadon, Karen Irvine, Nancy Snyder, Mark Gumula and Bill Gillan.
This is the first step toward the new Cape Haze we discussed in
"Image 2010".
Pam Neer has begun the process of obtaining plans
and drawings for the upgrade of our clubhouse so that we can work
towards upgrading our community center. The pool is now working well
with no issues. Thanks Peter Hayes.
The long expected re-paving of our streets will
begin early next year. The issue of sewers is still unresolved, but
will be addressed by our MSBU Board representative and the CHPOA
Board. On that subject, after eight years of outstanding service
Kurt Schramm will be leaving this role and we need to find a
replacement for him (see the "Help Wanted" ad in this edition).
Virtually everything that gets done in our
community is dependent on volunteers. If one of us doesn’t do it, it
doesn’t get done. To continue to make Cape Haze the desirable place
it’s been we need the contributions of time, thought and effort from
all of our residents. Please come to our meetings and please be a
volunteer.
Finally, your Board, working through "The Friends
of the Cape Haze Peninsula", will continue to fight to assure that
the character of our area remains what all of us would like it to
be. We recognize that development will occur and, while not everyone
may be keen about it, we want to be certain that it is in
conformance with applicable laws and statutes and does not harm our
sensitive environment. We have successfully fought harmful or
non-compliant development and will continue to take a stance that
promotes sound use of the assets of our area.
